University of Colorado student Austin Wilkerson sexually assaulted an intoxicated freshman after telling his friends he was going to help her home.
Boulder District Judge Patrick Butler said, "I’ve struggled, to be quite frank, with the idea of, ‘Do I put him in prison?’ I don’t know that there is any great result for anybody. Mr. Wilkerson deserves to be punished, but I think we all need to find out whether he truly can or cannot be rehabilitated."
Wilkerson was convicted of felony sexual assault, that could have resulted in a prison sentence of 4 to 12 years. Instead, Judge Butler sentenced Wilkerson to 20 years' probation and 2 years in a work-release program.
Just like Judge Persky's sentence of six months in county jail for the sexual assault of an unconscious woman committed by Stanford swimmer Brock Turner, our justice system is failing sexual assault survivors.
